What are the consequences of discrimination?

After determining that prohibited discrimination has occurred, the Ombudsman for Minorities issues a warning or instruction to discontinue the discrimination. In some cases, the Ombudsman for Minorities can assist in the preparation of an arbitration proposal.

If the matter is taken to the National Discrimination Tribunal of Finland, the Tribunal may impose a conditional fine to enforce a possible prohibition of discrimination. 

If the discrimination is handed over to the police for investigation, the case is handled in a court of law after preliminary investigation and decision to prosecute. In accordance with the Penal Code, discrimination is punishable by a fine or a maximum prison sentence of six months.

In addition, it is also possible to institute separate proceedings for compensation within two years of the event.
 
According to the Non-Discrimination Act, a maximum of EUR 15,000 can be awarded as compensation for ethnic discrimination. In practice, courts have awarded compensation ranging from EUR 50 to a few thousand euros. Furthermore, victims of discrimination can demand compensation for financial losses in accordance with the Tort Liability Act.
